TERMS OF SERVICE

Welcome to SwishFilm ("we," "our," "the Platform"). By accessing or using SwishFilm, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. Description of Service

SwishFilm is a private, invite-only platform for youth basketball teams to upload, organize, and share game film and photos among authorized team members, families, and coaches.

2. Eligibility & Age Requirements

• You must be at least 13 years of age to create an account on SwishFilm.
• If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and consented to these Terms.
• Users under 13 may not create accounts. Parents or guardians may create accounts on behalf of minor children.

3. Accounts & Access

• Access to team content is granted by team administrators (coaches) or authorized team members via invite.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account access, invite links, or authentication PINs with unauthorized individuals.
• We reserve the right to suspend or terminate any account at any time for any reason.

4. Content & Uploads

• You retain ownership of all content you upload to SwishFilm.
• By uploading content, you grant SwishFilm a limited, non-exclusive license to store, display, and deliver that content to authorized team members through the Platform.
• You represent and warrant that you have obtained all necessary consents from parents, guardians, or legal representatives of any individuals appearing in uploaded content, including minors, for that content to be shared with team members on this Platform.
• You may not upload content that is illegal, abusive, obscene, or violates any third party's rights.
• We do not claim ownership of your content and will not sell, license, or distribute your content to third parties.

5. Protection of Minors

• SwishFilm contains video and images of minor athletes. All users must treat this content with appropriate care and respect.
• You may not download, redistribute, publish, or share game film or photos outside the Platform without explicit consent from the team administrator and the parents/guardians of the minors depicted.
• You may not use any content from SwishFilm for commercial purposes without written permission.
• Any user found misusing content depicting minors will be immediately removed and may be reported to law enforcement.

6. Acceptable Use

You agree not to:

• Use the Platform for any purpose other than its intended team film management purpose
• Attempt to access content for teams you are not authorized to view
• Share invite links or access credentials publicly (social media, forums, etc.)
• Use automated tools, bots, or scrapers to access the Platform
• Interfere with the Platform's operation or security

7. Content Removal & Right to Delete

• Team administrators may remove any content at any time.
• Parents or guardians of minors depicted in content may request removal of that content by contacting the team administrator.
• You may request deletion of your account and associated data by contacting us.

8. Disclaimer of Warranties

SwishFilm is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, SwishFilm and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or content, arising from your use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless SwishFilm and its operators from any claims, damages, or expenses arising from your use of the Platform, your content uploads, or your violation of these Terms.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the Platform.
